This page combines our Terms of Service, Privacy Policy, Cookie Policy summary, and E‑commerce Terms. By using signalboardanalytics.com (the “Site”) or purchasing/using our services (the “Services”), you agree to these terms.
1) Terms of Service (TOS)
1.1 Scope & Acceptance
These Terms govern your access to and use of the Site, store purchases (e.g., Quickstart Kits, Sprints, Packages, Retainers), and consulting/analytics work we perform.
1.2 Eligibility
You must be at least the age of majority in your jurisdiction and have authority to bind your organization.
1.3 Your Account
If you create an account, you are responsible for safeguarding credentials and activity under your account.
1.4 Acceptable Use
You agree not to misuse the Site or Services, including but not limited to: security violations; reverse engineering; sharing credentials; sending malware; scraping; infringing intellectual property; or using our outputs to break laws/regulations (e.g., data privacy, anti‑spam, export controls).
1.5 Ordering, Statements of Work (SOW), and Store
- Store purchases (e.g., Data Analytics Quickstart Kit, Data Foundation Sprint, Premium Analytics Package, Monthly Support Retainer) are governed by these Terms and any product‑specific description on the product page.
- Consulting projects may include a quote, proposal, or SOW. If a conflict exists, the signed SOW controls for that project.
1.6 Payments, Taxes, & Invoicing
- We accept the payment methods shown on the Site (e.g., credit card via processors like Stripe/PayPal). We do not store full card numbers.
- Prices are in USD unless stated otherwise. You are responsible for any applicable taxes.
- For retainers/ongoing services, you authorize recurring billing until canceled per Section 1.7.
1.7 Subscriptions & Cancellation (Monthly Support Retainer)
- Billed monthly in advance; renews automatically each month.
- You may cancel at least 5 business days before the next renewal to avoid the next charge.
- Work stops at the end of the paid term. Unused hours do not roll over unless your SOW says otherwise.
1.8 Refunds
- Fixed‑fee kits/sprints/packages: 50% refundable if you cancel before project kickoff; non‑refundable after kickoff due to resource allocation.
- Monthly retainers: non‑refundable once the billing cycle begins.
- If a statutory right to refund applies in your jurisdiction, we will honor it.
1.9 Deliverables & Intellectual Property
- Your data remains yours.
- Unless your SOW says otherwise, we grant you a perpetual, non‑exclusive, worldwide license to use project deliverables we create for you (dashboards, data models, documentation, and code snippets specifically configured for your environment).
- SBA retains ownership of background IP and reusable know‑how/accelerators (e.g., generic scripts, frameworks, and templates developed or owned by SBA). We license those to you only as needed for your deliverables.
1.10 Client Responsibilities
You are responsible for:
- Providing accurate information, timely access, and any necessary credentials.
- Ensuring you have the right to share third‑party data with us.
- Complying with applicable laws and vendor/platform terms (e.g., Microsoft Power BI, AWS).
1.11 Confidentiality
Each party will keep the other party’s confidential information secret, using at least reasonable care, and not disclose it except to employees/contractors with a need to know under similar confidentiality obligations. This survives termination.
1.12 Data Processing & Security
- For client data you provide, SBA acts as a processor/service provider and will process only on your documented instructions to deliver the Services.
- We implement reasonable administrative, technical, and physical safeguards (TLS in transit, hardened cloud infrastructure, MFA for admin accounts, least‑privilege access).
- At project end, we will return or delete project data at your written request, subject to legal retention needs.
1.13 Warranties & Disclaimers
- We warrant we will perform Services in a professional and workmanlike manner consistent with industry standards.
- No other warranties (express or implied), including fitness for a particular purpose or non‑infringement.
- Analytics outputs and forecasts are decision‑support tools; results depend on your data quality, implementation, and external factors.
1.14 Limitation of Liability
To the maximum extent permitted by law:
- No indirect or consequential damages (including lost profits, revenue, data, or business opportunities).
- Aggregate liability for all claims relating to the Services is limited to the greater of (a) amounts you paid to SBA for the Services in the 3 months before the claim or (b) $1,000.
1.15 Indemnification
You agree to indemnify and hold SBA harmless from third‑party claims arising from your misuse of the Services, violation of these Terms, or infringement caused by your data or instructions.
1.16 Termination
Either party may terminate for material breach if not cured within 30 days of written notice. We may suspend/terminate immediately for security risks, fraud, or nonpayment. Upon termination, you must pay for Services rendered; confidentiality and IP/license terms survive as stated.
1.17 Governing Law & Dispute Resolution
- Governing law: State of Colorado, USA (without regard to conflicts of law).
- Disputes: The parties will first attempt to resolve disputes informally. If unresolved, disputes will be brought in state or federal courts located in Boulder County, Colorado. You consent to personal jurisdiction there.
- You and SBA waive class actions to the fullest extent permitted by law.
1.18 Changes to Terms
We may modify these Terms with notice on the Site. Changes apply prospectively. Continued use indicates acceptance.
2) Privacy Policy
This section summarizes how we collect, use, and protect personal information. (It consolidates the privacy text we drafted previously.)
2.1 What we collect
- You provide: name, email, phone, company, role, form inputs; order details; project data shared for consulting.
- Automatic: IP, device/browser data, pages viewed, timestamps, and cookie‑based analytics.
- Third parties: payment confirmations, analytics metrics, public business info.
2.2 How we use data
Provide and improve Services; process transactions; communicate; secure our systems; analyze performance; and (with consent where required) send marketing updates. See your rights below.
2.3 Legal bases (GDPR/UK GDPR where applicable)
Contract, legitimate interests, consent, and legal obligations.
2.4 Sharing
We do not sell personal data. We share with processors (hosting, payments, CRM, analytics), professional advisors, in business transfers, or as required by law.
2.5 Your rights & choices

2.6 Retention
We retain data as needed for Services, legal obligations, and security, then delete or de‑identify.
2.7 Security
We use reasonable safeguards; no method is 100% secure. We will notify you of data incidents as required by law.
2.8 International transfers
If you are outside the U.S., your data may be processed in the U.S. or other countries with different laws; we use appropriate safeguards where required.
2.9 Children
Not directed to children under 13 (or older where required). We do not knowingly collect children’s data.

3) Cookie Policy (Summary)

4) E‑commerce & Product‑Specific Terms
4.1 Digital Products & Services
- Deliverables are digital (dashboards, reports, code, documentation). No physical shipment.
- Delivery occurs by email, download, or access credentials after payment and intake.
4.2 Pricing, Promotions & Errors
- We may run promotions or discounts. If a pricing error occurs, we may cancel/refund and correct the error.
4.3 Support & Maintenance
- Quickstart Kit / Sprint / Package: includes the support described on the product page/SOW.
- Monthly Support Retainer: ongoing support per the plan; unused hours do not roll over unless specified.
4.4 Third‑Party Licenses
You are responsible for any third‑party licenses required (e.g., Microsoft Power BI Pro/Premium, AWS services). We will advise requirements during scoping.
4.5 Client Data & Access
You grant SBA the rights necessary to process your data solely to deliver the Services. You remain the data controller/owner of your datasets.
5) Data Processing Addendum (DPA) — Summary
When SBA processes personal data on your behalf (e.g., customer lists, HR or sales data), our DPA applies (incorporated by reference or attached to your SOW):
- Process only on your documented instructions.
- Confidentiality commitments for personnel.
- Appropriate security measures; breach notifications.
- Subprocessor controls; Standard Contractual Clauses where required.
- Return or deletion of data at end of engagement, subject to legal retention.

6) Accessibility Statement (Summary)
We aim to provide an accessible experience and continuously improve. If you encounter accessibility issues, contact info@signalboardanalytics.com and we will assist.
7)Refunds
If no work has started and no analysis has been performed, you may request a cancellation and receive a full refund. Or in the rare event that a project cannot be completed due to an external technical error or some other constraints.
- A partial or full refund depending on the work completed, or
- The option to apply the remaining balance to another service.
No Refunds Are Provided For:
- Work that has already been completed
- Analytics deliverables already delivered (reports, dashboards, models, etc.)
- Time spent on consulting, strategy calls, scoping, or analysis
- Services involving custom research, code, or design
- Fixed-fee packages once initial analysis has begun (including the $300 single dataset package)
If you are dissatisfied with the work, we will make every reasonable effort to revise or clarify the deliverables within the agreed project scope. All efforts will be made to ensure client satisfaction in all cases
